The Government has published a factsheet explaining the compulsory purchase and compensation reforms, which have been included in the Planning and Infrastructure Bill. The Bill is expected to receive Royal Assent at the end of November, so we can give you a practitioners view of what it contains and how it may affect you.
The reforms represent some of the most significant changes to the CPO regime in recent years; albeit caveated with the Law Commission reforms currently being prepared.
The session will include:
- Delegation of decision-making on CPOs, hope value directions and compensation claims
- Earlier possession powers for acquiring authorities under some circumstances under the general vesting declarations procedure
- Changes to temporary possession provisions across different consenting regimes
- Electronic service of notices and streamlined publicity requirements
- The extension of hope value removal to affordable/social housing acquisitions
- Adjustments to landlord/occupier loss payments and home loss exclusions
The Government's response has been described as “interesting reading” – with some sensing that consultation feedback made little difference to the outcome in this report. That suggests a direction of travel practitioners should be aware of.
This event provides the perfect opportunity to deep dive into what is now Government plans, and what impact it shall have in practice. Anyone advising or operating in the Compulsory Purchase or compensation space should be attending.
